David Kell SC appears regularly in leading cases in the High Court of Australia, the Supreme Court of New South Wales (including the Court of Appeal and Court of Criminal Appeal) and a range of other courts and tribunals.
David has experience and expertise in the fields of administrative law, criminal law, inquiries, intellectual property, contempt, child protection, equity and commercial law. He has been Counsel Assisting in a number of large inquiries and inquests, including Special Commissions of Inquiry.
David has a doctorate in law from the University of Oxford, and was an Associate to a High Court judge (Justice Michael McHugh). He also practised as a solicitor, including with an Australian based multinational law firm.
David has published numerous articles in leading journals on topics including evidence, constitutional law, civil procedure, criminal law and intellectual property. He is a co-author of a book on the Trade Marks Act 1995 (Cth) (LexisNexis), which is in its third edition.
He presently holds the full-time, statutory office of the Crown Advocate of New South Wales, and is unable to accept private briefs at this time.
