Experience:

Since coming to the Bar, Hernan has acted in a diverse range of commercial and public law matters including:

  • Johnston v Endeavour Energy; More & More v Endeavour Energy (for Endeavour Energy);
  • Coronial Inquiry into the Springwood and Mount Victoria Bushfires (for Endeavour Energy);
  • Queensland Health Payroll Commission of Inquiry (for IBM Australia Ltd);
  • ICAC Operation Credo Public Inquiry (for Mr MacGregor-Fraser);
  • Aboriginal Land Rights Act matters (for New South Wales Aboriginal Land Council);
  • Johnson Controls Australia Pty Limited v Webb Australia Group (NSW) Pty Limited (for Cummins Generator Technologies Germany GmbH);
  • Mass Holdings Pty Ltd v EPS Constructions Pty Limited (for Mass Holdings Pty Ltd); and
  • Opie Holdings Pty Limited v Richard Opie (for Mr Opie).

He has also appeared at mediations and drafted legal advices in relation to complex issues of statutory and contractual interpretation.

As a solicitor with King & Wood Mallesons from 2009 to 2012, Hernan acted in numerous international commercial arbitrations. He also acted for White Industries Australia Limited in its successful investment treaty claim against the Republic of India.

Prior to becoming a lawyer, Hernan worked for nearly fifteen years in the government, business and community sectors. During his career, he has worked at the highest levels of government, including as Chief of Staff to a senior NSW Cabinet Minister and as an Adviser to the Commonwealth Attorney-General and the Minister for Justice. He has also worked in the Department of Prime Minister and Cabinet.


Education:

  • Bachelor of Laws (First Class Honours and University Medal for Law), University of NSW.
  • Bachelor of Arts (Honours) majoring in political science and history, Australian National University.

Awards and Prizes:

Various awards and prizes incuding:

  • The Sir Gerard Brennan Public International Law Essay Prize (2009);
  • Harmers Workplace Lawyers Award in Employment Law (2008);
  • LexisNexis Australia Prize for Undergraduate Litigation 1 (2008);
  • The Sir Alan Taylor Graduate Prize (2007, shared).

Ranked 7th best oralist in Jessup International Law Moot, International Rounds, Washington DC (2008).
